Today is a huge victory for behavioral health clinicians in the Commonwealth! After 5 years of hard work, Governor Baker signed the state budget with the clawback bill in it, protecting clinicians who have had to deal with predatory clawback practices from insurance companies.
This is one of the first bills that CliniciansUNITED and SEIU Local 509 wrote and filed on behalf of private practice clinicians, and we have fought long and hard for this victory. Over these past 5 years, so many of you have called and written your legislators and showed up in their offices demanding that they protect clinicians from this predatory insurance practice. Thanks to each and every one of you who shared your stories, lobbied your legislators, and helped make this possible.
This is going to make a difference right away across the Commonwealth. We have heard from hundreds of clinicians that have had to deal with clawbacks costing them up to $30,000 in repayments over the years. Because we fought for this bill, insurance companies can no longer go back years in the past to audit and demand clawbacks from providers. There is now a time limit of 12 months for insurance companies to review payments for services.
This is a great example of what we can achieve when we fight together for what’s right. And when we fight, we win!
