STEWARDS: DO YOU HAVE A TIP TO SHARE?
| March 24, 2009
"Time & Date TBA" A coworker asks you to come with her tomorrow at 3:00 pm, when she has to meet with an investigator. Unfortunately, you are not able to be there at 3:00.
Does she have to go alone if you cannot change your schedule?
You have a right to notify the investigator that the worker has requested union representation, that you are her steward, but that, regrettably, you can’t make it at 3:00 pm tomorrow. Then you can work out a mutually convenient time (within reason) with the investigator.
If, for some reason, the investigator refuses to reschedule and insists on meeting with the worker at the original time, the worker must attend the meeting; however, she may refuse to answer questions by stating the following ("Weingarten Rights"):
“If this discussion could in any way lead to my being disciplined or terminated, I respectfully request that my union representative or steward be present at this meeting. Without my representative present, I choose not to respond to any question or statement.”
If this happens, talk to your Field Rep about how to make sure it does not happen again.
